| 近年来，我国社区体育场地设施存在被侵占、运营维护差、配建标准落实不足等问题，导致居民体育权利受到侵犯。该类问题难以治理源于复杂的群体权利冲突，硬法资源或行政管制嵌入治理存在一定缺陷，而软法在治理过程中具有一定优势，主要体现在基层体育发展现状决定了软法实施的合理性、基层体育治理的困境决定了软法实施的最优性、权利冲突难调和决定了软法实施的有效性和正当性。当前，社区体育场地设施治理中软法介入还存在一些问题，迫切需要行政机关转变管理思路，完善体育软法规制内容和创制程序，健全软法实施机制，以保证软法在基层体育治理中取得实效。 |

| The Implementation Advantages and Guarantee Conditions of Soft Law in the Governance of Community Sports Facilities in China |

| In recent years, there have been problems such as encroachment, poor operation and maintenance, and insufficient implementation of construction standards in China’s community sports facilities, resulting in violations of residents’ sports rights. The difficulty of governance of such problems stems from the complex conflict of group rights. There are some defects in the embedding of hard law resources or administrative control into governance, while soft law has certain advantages in the process of governance. It is mainly reflected in the fact that the current situation of grass-roots sports development determines the rationality of the implementation of soft law, the dilemma of grass-roots sports governance determines the optimality of the implementation of soft law, and the difficulty of reconciling rights conflicts determines the effectiveness and legitimacy of the implementation of soft law. At present, there are still some problems in the intervention of soft law in the governance of community sports venues and facilities. It is urgent for administrative organs to change their management ideas, improve the content and creation procedures of sports soft law regulation, and improve the implementation mechanism of soft law, so as to ensure that soft law can achieve practical results in grass-roots sports governance. |
