| 青少年体育和学校体育工作是实现体育强国、教育强国和健康中国战略目标的重要环节。新修订的《体育法》将青少年和学校体育提升至优先发展的战略地位，通过扩大保障范围和完善条款内容强化制度保障。通过对新《体育法》青少年和学校体育章规范的系统分析发现，当前体育教育权利从应然到实然的过程中存在缺少权利宣示性条款、内部治理架构碎片化和外部保障资源不足等问题。基于此提出，在《学校体育工作条例》修订中增设体育教育权利宣示性条款，为权利义务等要素配置提供合理依归；优化体教部门协同机制，推动社会力量参与治理，促进体教融合和政社协作；通过法律解释强化体育教师和场地设施的资源保障。 |

| Youth and School Sports Chapter of the New Sports Law: Clause Deconstruction, Realistic Reflection, and Interpretive Supplement |

| Abstract: |
| Youth and school sports work is an important part of realizing the strategic goals of sports power, education power and a healthy China. The newly revised Sports Law promotes youth and school sports to a strategic position of priority development, and strengthens institutional guarantees by expanding the scope of protection and improving the clause content of the provisions. Through the systematic analysis youth and school sports chapter norms of the new Sports Law, it is found that there are problems such as lack of rights declaration clauses, fragmentation of internal governance structure and insufficient external guarantee resources in the process of current physical education rights from “ought-to-be” to “be”. Based on this, this paper proposes to add a declaratory clause of physical education rights in the revision of the School Physical Education Work Regulations, so as to provide a reasonable basis for the allocation of rights and obligations and other elements; optimize the coordination mechanism of sports and education departments, promote the participation of social forces in governance, and promote the integration of sports and education and the cooperation between government and society; strengthen the resource guarantee of physical education teachers and venue facilities through legal interpretation. |
