| 体育赛事网络直播节目的性质使其无法完整嵌入著作权制度的保护框架，在原《著作权法》中邻接权和著作权保护模式均存在适用困境，修改后的《著作权法》用视听作品取代电影作品和类电作品，将网播行为纳入广播权和广播组织者邻接权规制的范围，为体育赛事网络直播节目的保护提供了新思路与可能性，但依然存在适用不畅问题。通过确立“有无”的独创性标准，扩大广播组织者权的主体，创设向公众传播权，可进一步优化体育赛事网络直播的著作权法律适用，促进体育赛事直播产业的健康发展。 |

| The Dilemma and Optimization Countermeasures of the Application of the Copyright Law on the Live Webcast of Sports Events |

| Abstract: |
| The nature of live webcasts of sports events makes it impossible to be fully embedded in the protection framework of the copyright system. In the original Copyright Law, there are difficulties in the application of neighboring rights and copyright protection models. The revised Copyright Law replaces film works and works similar to films with audio-visual works, and incorporates webcast into the scope of broadcasting rights and broadcasting organizers’ neighboring rights, which provides new ideas and possibilities for the protection of live webcasts of sports events. However, there are still problems of poor application. By establishing the original with-or-without standard, expanding the subject of broadcasting organizers’ rights, and creating the right of communication to the public, we can further optimize the application of copyright law in the live broadcast of sports events and promote the healthy development of the live broadcast industry of sports events. |
